This Terms of Service Agreement (“Agreement”) constitutes a legally binding contract between you (“User,” “Customer,” or “you”) and Fuzhou Taijiang Hangcheng Yiyu Network Technology Co., Ltd. (“Company,” “we,” “us,” or “our”), operating under the brand Maketpower. By accessing or using our digital platform (“Site”), including any associated services or making a purchase of our desktop decor products, you acknowledge that you have read, fully understand, and irrevocably agree to be bound by these terms. Your continued use of the Site signifies your ongoing acceptance of this Agreement.

1. Intellectual Property Rights
All content, features, and functionality on the Site are and will remain the exclusive property of the Company and its licensors. This includes, but is not limited to:

  • The Site’s software, code, structure, and “look and feel.”
  • Our trademarks, service marks, logos, and brand identifiers (“Maketpower” and associated logos).
  • All product designs, images, photographs, descriptions, text, graphics, icons, and audio/video clips.
  • The compilation of all content on the Site.
    This intellectual property is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for personal, non-commercial purposes only.

2. User Obligations
By using the Site, you represent and warrant that:

  • You are at least 18 years of age or the age of majority in your jurisdiction.
  • You will use the Site for lawful purposes only and in compliance with all applicable local, national, and international laws and regulations.
  • You will not engage in any activity that interferes with, disrupts, or places an undue burden on the Site or its underlying networks and security systems.

3. Commercial Terms & Product Sales

A. Product Availability: We reserve the right, at our sole discretion, to limit the quantity of items purchased per person, per household, or per order. We may discontinue any product at any time. All descriptions of products and their pricing are subject to change without notice.

B. Product Descriptions: We strive to display product colors and images as accurately as possible. However, we cannot guarantee that your device’s display will accurately reflect the product’s exact color or detail. Slight variations in finish or texture may be inherent to handcrafted or natural materials used in desktop decor.

C. Pricing and Orders: Prices are subject to change. We reserve the right to correct any pricing errors, even after an order has been placed. Your order confirmation constitutes our acceptance of your offer to purchase. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities, inaccuracies in product or pricing information, or issues identified by our fraud prevention protocols.

4. Returns & Refunds
All purchases are subject to our Maketpower Return & Refund Policy, which is expressly incorporated into this Agreement by reference. By completing a purchase, you agree to the terms of that policy.

5. Acceptable Use
You agree not to use the Site to:

  • Engage in any fraudulent, deceptive, or illegal activity.
  • Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission.
  • Attempt to gain unauthorized access to any part of the Site, other accounts, or any connected network or server.
  • Interfere with or disrupt the integrity or performance of the Site.

6. User-Generated Content
If you submit any content to the Site (e.g., reviews, photos, comments), you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and display such content. You represent that you own or have the necessary rights to any content you submit and that it does not violate any third-party rights.

7. Privacy
Your use of the Site is also governed by our Maketpower Privacy Policy, which is incorporated into this Agreement by reference. Please review it to understand our data practices.

8. Termination
We may suspend or terminate your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including if you breach this Agreement.

9. Modifications to Service & Terms
We reserve the right to modify, suspend, or discontinue the Site (or any part of it) at any time. We may also revise this Agreement at our sole discretion. The most current version will be posted on the Site. By continuing to use the Site after changes are posted, you agree to the revised terms.

10. Governing Law
This Agreement shall be governed and construed in accordance with the laws of the People’s Republic of China, without regard to its conflict of law provisions.

11. Dispute Resolution
Any dispute arising from or relating to this Agreement shall first be attempted to be settled through friendly negotiation. If negotiation fails, the dispute shall be submitted to the competent people’s court in Fuzhou City, Fujian Province, where our company is legally domiciled.

12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE SITE OR PRODUCTS.
